Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at travenlabs.com and any related pages, content, and features we make available through it (the "Site"), operated by Traven Labs LLC ("Traven Labs," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Scope of these Terms

These Terms apply to your use of the Site only. They are an agreement about an informational and marketing website, including features such as contact and lead forms, scheduling and booking tools, and any account registration we may offer for accessing the Site.

These Terms do not govern access to or use of any paid product, platform, model, analysis, or other service that Traven Labs provides to a client (collectively, the "Services"). Any provision of the Services is governed exclusively by a separate written agreement signed between Traven Labs and the client, such as a master services agreement, cloud service agreement, order form, statement of work, pilot agreement, or data processing agreement. If there is any conflict between these Terms and such a signed agreement with respect to the Services, the signed agreement controls.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. The Site is intended for businesses and professional users, not for personal, household, or consumer use, and it is not directed to children.

3. Accounts

If we make account registration available, you agree to provide accurate information, to keep your credentials confidential, and to be responsible for activity that occurs under your account. Notify us promptly at legal@travenlabs.com if you believe your account has been accessed without authorization. We may suspend or disable accounts at our discretion, including for suspected violation of these Terms.

4. Acceptable use

You agree not to, and not to permit anyone to:

• use the Site for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to the Site, its systems, or related networks;
• interfere with or disrupt the integrity or performance of the Site;
• probe, scan, or test the vulnerability of the Site or circumvent any security or access controls;
• scrape, crawl, harvest, or use automated means to extract data from the Site except as expressly permitted by us in writing;
• copy, reproduce, republish, or redistribute Site content except as permitted under these Terms;
• use the Site to transmit malware, spam, or other harmful or deceptive material; or
• misrepresent your identity or affiliation.

5. Intellectual property

The Site and its content, including text, graphics, logos, the Traven name and marks, designs, layouts, and software, are owned by Traven Labs or its licensors and are protected by intellectual property and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your internal business and informational purposes. No other rights are granted. You may not use our name, logo, or marks without our prior written permission.

Any feedback or suggestions you choose to provide about the Site or our offerings may be used by us without restriction or obligation to you.

6. Third-party links and services

The Site may contain links to, or rely on, third-party websites and services that we do not control, such as scheduling, analytics, or hosting providers. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and policies.

7. Communications

If you submit a form, book a meeting, or otherwise contact us through the Site, you agree that we may contact you in response, including by email, regarding your inquiry and our offerings, consistent with our Privacy Policy. You can opt out of non-essential communications at any time.

8. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect and handle information. By using the Site, you acknowledge the Privacy Policy.

9. Disclaimers

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Traven Labs disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any content on the Site is accurate, complete, or current. Any content on the Site is provided for general informational purposes only and is not professional, legal, financial, or other advice.

10. Limitation of liability

To the fullest extent permitted by law, in no event will Traven Labs or its officers, members, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages. To the fullest extent permitted by law, the total aggregate liability of Traven Labs arising out of or relating to the Site and these Terms will not exceed one hundred US dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Traven Labs and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Site or your violation of these Terms or of any applicable law or third-party right.

12. Changes to the Site and to these Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above, and the updated Terms take effect when posted. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.

14. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Site that is not otherwise resolved will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. Before filing any claim, the parties agree to first attempt in good faith to resolve the dispute informally by contacting legal@travenlabs.com.

15. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and Traven Labs regarding the Site and supersede any prior agreements regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them freely. Nothing in these Terms creates any partnership, agency, or employment relationship between you and Traven Labs.
